Introduction
job.com, LLC (“job.com,” “we,” “us,” or “our”) operates an online platform that connects Job Seekers with Employers (the “Platform”). These Terms and Conditions (“Terms”) govern your access to and use of www.job.com and any related websites, mobile applications, features, or services we offer (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. If you are using the Platform on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
The Platform is intended for users who can form legally binding contracts. It is not available to minors under 18 (or the age of majority in your jurisdiction). Your use of the Platform is also governed by our Privacy Policy, incorporated herein by reference.
Modifications to These Terms
We may update these Terms from time to time. We will notify users of material changes (e.g., via email, in-app notice, or a prominent banner). Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. We encourage you to review the Terms periodically.
User Accounts and Registration
You must create an account to access certain features. You agree to:
- Provide accurate, complete, and current information.
- Maintain and promptly update your account information.
- Keep your login credentials confidential and notify us immediately of any unauthorized access.
Job Seekers must provide name, contact details, location, resume, and other requested information.
Employers must provide company details and other information reasonably requested.
We reserve the right to refuse registration, suspend, or terminate accounts for any reason, including suspected violations of these Terms.
Communications (Email, Calls, Texts)
By providing your contact information, you consent to receive service-related communications. You may also opt into marketing or job alerts. You can opt out of non-essential communications as described in our Privacy Policy or by following unsubscribe instructions. Message and data rates may apply for SMS.
Platform Use – Permitted and Prohibited Activities
You may use the Platform only for lawful purposes in accordance with these Terms.
You are prohibited from:
- Scraping, data mining, crawling, or using automated tools (robots, spiders, etc.) without express written permission.
- Transmitting spam, viruses, or harmful code.
- Posting discriminatory, fraudulent, defamatory, or illegal content.
- Impersonating others or misrepresenting affiliations.
- Interfering with the Platform’s operation or security.
- Using the Platform for any commercial purpose other than legitimate job seeking or recruiting (as applicable).
- Violating applicable laws, including employment, anti-discrimination, data protection (e.g., CCPA/CPRA, GDPR if applicable), or anti-spam laws.
Our Role; No Employment Agency Guarantee
We provide a matching platform. We do not:
- Guarantee matches, hires, or job performance.
- Act as an employer or employment agency in most cases.
- Verify the accuracy of job postings or candidate information.
Employers and Job Seekers are solely responsible for due diligence, compliance with employment laws, background checks, and any resulting employment relationships. We disclaim all liability for interactions or agreements between users.
Employers must comply with all applicable labor and anti-discrimination laws when posting jobs and interacting with candidates.
AI Usage on the Platform
job.com may use artificial intelligence (AI) tools to enhance features such as resume parsing, job matching, candidate screening, job recommendations, content summarization, and search optimization.
You acknowledge and agree to the following:
- AI-Generated Content: Any AI-assisted outputs (e.g., suggested job descriptions, resume summaries, or match recommendations) are provided for convenience only. You are solely responsible for reviewing, verifying, and ensuring the accuracy, completeness, and appropriateness of all AI-generated content before use. We do not guarantee the accuracy, reliability, or bias-free nature of AI outputs.
- User Responsibility: When using AI features, you must not input sensitive personal data, confidential information, or protected health information unless expressly permitted. You remain fully responsible for compliance with all applicable laws (including anti-discrimination, data privacy, and employment laws) when relying on or publishing AI-generated content.
- No Automated Decisions Alone: Any AI-assisted screening or matching is preliminary. Final hiring or employment decisions must involve human review and must comply with all applicable laws.
- Prohibited Uses: You may not use the Platform’s AI features to generate discriminatory, unlawful, or harmful content, or to circumvent any laws or Platform rules.
- Changes to AI Features: We may modify, suspend, or discontinue AI features at any time without liability.
Pay Transparency Compliance
Employers using the Platform are solely responsible for complying with all applicable pay transparency, equal pay, and wage disclosure laws in the jurisdictions where they post jobs or recruit candidates (including, but not limited to, laws in California, New York, Colorado, Illinois, and other states or localities that require salary ranges, benefits descriptions, or other compensation information in job postings).
Employers must ensure that all job postings on the Platform include any required pay or compensation information in accordance with applicable law.
job.com does not verify or enforce Employer compliance with pay transparency laws. We reserve the right (but have no obligation) to remove or require correction of non-compliant postings.
You agree to indemnify and hold job.com harmless from any claims, penalties, or liabilities arising from your failure to comply with pay transparency or related employment laws.
User Content and Job Postings
You grant us a worldwide, royalty-free, perpetual license to use, display, and distribute content you post (resumes, job ads, etc.) as necessary to operate the Platform.
You represent that your content is accurate, non-infringing, and complies with all laws. We may remove content at our discretion.
Intellectual Property
All Platform content, design, logos, and technology are owned by job.com, LLC or its licensors. You receive a limited, revocable license to use the Platform as permitted. You may not copy, modify, or create derivative works without permission.
Third-Party Links and Integrations
We are not responsible for third-party websites, ads, or services linked from the Platform.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, job.com, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. Our total liability to you shall not exceed the greater of (i) the amount you paid us in the twelve (12) months preceding the claim, or (ii) $100.
Indemnification
You agree to indemnify and hold job.com, LLC, its officers, directors, employees, and agents harmless from any claims, losses, or damages arising from your use of the Platform, your content, or your violation of these Terms or applicable law.
Termination
We may suspend or terminate your access at any time for any reason. You may close your account via account settings.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
Miscellaneous
- Severability: Invalid provisions shall not affect the remainder.
- No Waiver: Failure to enforce a right does not waive it.
- Entire Agreement: These Terms (with Privacy Policy) constitute the full agreement.
- Electronic Communications: You consent to electronic notices and signatures.
